Terms of use
As of 1 April 2026 · The German version is legally binding.
Scope
These terms of use apply to the digital products of InnovationLAB GmbH, in particular SuperDuperChat (omnichannel communication) and Callana (AI telephony). Individual products may be subject to supplementary terms.
§ 1 General
Our platforms are available exclusively to businesses (B2B); consumers are excluded. Clients receive access only after individual review and activation; there is no legal entitlement to access. The current range of features is described on the respective product pages.
§ 2 Registration and user account
Registration requires name, email address, phone number, company name and industry, and payment details for paid packages. The account is activated after email confirmation and approval by InnovationLAB; we may refuse registrations without giving reasons.
Clients provide truthful information, keep their credentials confidential and report any suspected misuse without delay.
§ 3 Use of the platform and products
After activation the booked package is available to the client. SuperDuperChat includes in particular an omnichannel inbox, AI-assisted communication, channel integrations and workflow automation; Callana includes in particular automated call handling, appointment booking and integration with CRM and calendar.
The client is solely responsible for content and for actions triggered by its AI agents. Prohibited in particular are deceptive AI communication, unlawful processing of personal data, spam, harassment, and sublicensing or reselling the platform. Violations may lead to immediate suspension or termination.
§ 4 Liability and availability
The platforms are provided as they are; uninterrupted or error-free operation is not guaranteed. We are not responsible for outages caused by third parties (such as telecom, cloud or AI providers).
We are liable for intent and gross negligence. For slight negligence we are liable only for foreseeable damage typical of the contract arising from breach of essential obligations. Lost profits and consequential damage are excluded to the extent permitted by law. AI outputs may contain errors; the client is responsible for reviewing them.
§ 5 Data protection and processing
The GDPR and the Austrian Data Protection Act 2018 apply. The client remains the controller for its end customers' data; for data processed through channel integrations, InnovationLAB acts as processor. A data processing agreement under Art. 28 GDPR forms part of every client contract. See the privacy policy.
§ 6 Term and termination
The contract runs for an indefinite period and can be terminated by either party with 30 days' notice to the end of a month. The right to terminate for good cause remains unaffected, for example in the event of serious breaches of § 3 or payment arrears of more than 30 days.
After the contract ends, access is blocked and data is deleted within 30 days unless statutory retention obligations apply. Clients should export their data beforehand.
§ 7 Changes to these terms
Changes apply for the future and are announced by email at least 30 days in advance. If the client does not object within this period, they are deemed accepted. In the event of an objection, InnovationLAB may terminate the contract for good cause.
§ 8 Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for businesses is Innsbruck. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
